READ CAREFULLY – THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS

Metalsmithing and jewelry making are inherently dangerous activities. As such, Davide Bigazzi Studio requires all persons participating in any class, workshop, or private lesson, or using any Davide Bigazzi Studio equipment or facilities, to read and sign this Release and Waiver of Liability.

1. Acknowledgment of Risk

I understand and acknowledge that metalsmithing and jewelry making involve numerous inherent risks, including but not limited to:

  • The use of and exposure to superheated gases and torches;

  • Handling hot metals and solder;

  • Exposure to sharp tools and objects;

  • Use of hand and power tools;

  • Exposure to hazardous chemicals and materials.

I understand that these risks may result in personal injury, illness, burns, allergic reactions, property damage, or even death. I accept full personal responsibility for any injury or damages that may result from my participation, whether caused by my own actions, the actions of others, or the condition of the premises.

2. Assumption of Risk

I voluntarily and knowingly assume all risks, both known and unknown, associated with my participation in activities at Davide Bigazzi Studio, including those arising from the negligence of the studio or any individuals acting on its behalf, whether paid or unpaid.

3. Release of Liability and Agreement Not to Sue

To the fullest extent allowed by law, I hereby release, waive, and discharge Davide Bigazzi Studio and all of its owners, instructors, assistants (whether paid or volunteer), guest teachers, apprentices, monitors, employees, agents, and anyone acting under the direction of Davide Bigazzi Studio (collectively, the "Released Parties") from any and all claims, demands, or causes of action, whether known or unknown, arising from or related to:

  • Personal injury or property damage sustained while participating in studio activities;

  • Use or misuse of equipment or materials;

  • Instruction, construction, design, or manufacture of any product;

  • Application of techniques or information provided during any class, workshop, or private lesson.

I further agree not to sue any of the Released Parties for any such claims.

4. Indemnification and Responsibility

I agree to indemnify and hold harmless the Released Parties from any and all liability, claims, demands, damages, losses, costs, or expenses (including attorney’s fees) arising from or related to:

  • My participation in studio activities;

  • My actions or omissions;

  • Any injuries or damages I may cause to others while on the premises.

I understand that I am solely responsible for any damages resulting from my actions or the application of skills learned.

5. Governing Law and Venue

This agreement shall be governed by the laws of the State of California, and any legal action relating to this agreement shall be brought exclusively in the courts located in Santa Clara County, California.

6. Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By signing below, I acknowledge that I have read, understood, and voluntarily agree to the terms of this Release and Waiver of Liability. I understand that I am waiving certain legal rights, including the right to sue.
